Agi: L'Ue approva nuove norme per la tutela degli adulti vulnerabili AGI - Il Consiglio e il Parlamento europeo hanno raggiunto un accordo su nuove norme per garantire i diritti degli adulti che necessitano di protezione o sostegno in situazioni transfrontaliere. Ciò include i diritti relativi alla vendita di proprietà, all'assistenza medica o al trasferimento in un altro paese. Si tratta di norme importanti a fronte di un progressivo invecchiamento della popolazione. Secondo i dati dell'UE, si prevede che la percentuale di persone con più di 65 anni che vivono con una qualche forma di disabilità aumenterà del 77% entro il 2050. Tutela degli adulti vulnerabili La nuova legge tutelerà i diritti degli adulti che non sono più in grado di prendere decisioni senza un qualche tipo di supporto, ad esempio le persone affette da patologie legate all'età, come il morbo di Alzheimer, che sono assistite da un familiare o da un altro rappresentante. Allineamento alle norme internazionali Il regolamento ha l'obiettivo di allineare il diritto dell'UE alle norme internazionali stabilite dalla Convenzione dell'Aia sulla protezione degli adulti vulnerabili. Tutelerà l'autonomia degli adulti vulnerabili, compresa la loro libertà di scelta, quando si spostano all'interno dell'UE. Competenza e legge applicabile Nello specifico, le nuove norme stabiliscono quale tribunale è competente ad adottare misure di protezione in un caso transfrontaliero, quale legge si applica e le condizioni per il riconoscimento e l'esecuzione di misure o poteri di rappresentanza stabiliti all'estero. Giurisdizione nei casi transfrontalieri Il nuovo regolamento chiarisce quale tribunale nazionale ha giurisdizione nei casi transfrontalieri riguardanti la tutela degli adulti. Si basa sulla Convenzione dell'Aia, che collega la giurisdizione a fattori quali la residenza abituale, la nazionalità o l'ubicazione dei beni di una persona. Entrata in vigore del regolamento Una volta che il testo sarà stato finalizzato e formalmente approvato dai colegislatori, la nuova legislazione entrerà in vigore 20 giorni dopo la sua pubblicazione nella Gazzetta ufficiale dell'UE. Jurisdiction in Cross-Border Cases The new regulation clarifies which national court has jurisdiction in cross-border cases concerning the protection of adults. It is based on the Hague Convention, which links jurisdiction to factors such as a person's habitual residence, nationality, or location of assets. Entry into Force of the Regulation Once the text has been finalized and formally approved by the co-legislators, the new legislation will come into force 20 days after its publication in the Official Journal of the EU.
